包裝、運輸標(biāo)志和保證也是合同中重要的一部分。這次我們就來看看有關(guān)它們的條款。
7. 包裝條款
包裝條款要包括包裝材料、具體要求以及其他要求。一般采用的方式有籠統(tǒng)表示和具體規(guī)定兩種。通常只有在雙方達到共識時才使用籠統(tǒng)表示方法。比如以下描述：customary
packing; seaworthy packing; packing suitable for long distance; 等等。
具體規(guī)定的描述就非常詳細了，例如下面這幾種：
1) 木箱裝，每箱裝30匹，每匹40碼。
To be packed in wooden cases, 30 pieces per case of
40 yd each.
2) 鐵桶裝，每桶凈重25公斤。
In iron drum of 25kg net each.
3)
用聚丙烯編制包裝袋，每包重50公斤，以毛重作凈重，包裝袋質(zhì)量良好，適于海運，包裝袋上用英語寫上品名、重量、原產(chǎn)國別和包裝日期。
To be packed
in polypropylene woven bags, 50kg each, gross for net. The bags should be fairy
good in quality and suitable for ocean transportation, on which the name of the
goods, weight, country of origin and package date should be written / marked in
English.
8. 運輸標(biāo)志
運輸標(biāo)志通常要包括以下內(nèi)容：
1) 一些指示性（indicative marks）和警告性（warning marks）的圖畫和語言。
比如：上指的雙箭頭的表示This side up; 雨傘表示Keep dry; 玻璃杯表示Breakable或者Handle with care;
等等。還有一些標(biāo)志，比如：poisons有毒；explosives易爆；inflammable易燃；等等。
2) 運輸標(biāo)志：a. 目的港名稱 b. 件號 c. 買賣雙方代號
3) 出口地：比如Made in China.
9. 保證條款
保證條款需要注明保證內(nèi)容和保證時間，即保證的起止日期。比如：
承包商同意對不符合圖紙規(guī)格的工程部分進行返工，并保證工程進行，同意完工一年后對有證據(jù)證明因瑕疵材料或工藝造成的缺陷進行補救。
The
contractor agrees to redo the part of the project which did not conformto the
drawings' specification with other projects performed / done meanwhile, remedy
defects caused by / result from / arise from faulty materials and workmanship
which are proved by evidence in one year after the completion of the project.
